How do military divorces differ from civilian divorces?
There are certain issues that can arise in a military divorce that aren't likely to come up in a civilian divorce. For example, it can be difficult to determine where you should file the divorce—which court has jurisdiction in your case? It could be a state in which the military spouse is a resident, or a state in which you both agree to file.
Military service can also affect how child support is calculated in a given case, and there are military pension rights and other benefits that must be considered in the asset division process. These benefits are subject to division in accordance with the laws of the state in which you file for divorce.
Finally, if the service member is deployed during the divorce, serving the paperwork and processing the divorce may be difficult. There are some delays a service member can seek if on deployment when they are served with divorce papers, but in general, having spouses located in different countries will always be a complicating factor.
